Basic requirements of the RUz legislation for authorization of civil aviation activities
For carrying out any activity in civil aviation related to the operation of an aircraft in accordance with the Air Code of the Republic of Uzbekistan (article 44) and the «Regulation on the procedure for issuing the certificate of operator in civil aviation of the Republic of Uzbekistan»Approved by the Decision of the Cabinet of Ministers of March 1, 2016, 58 legal (physical) persons in the Civil Aviation Agency need to receive the Certificate of Operator.
The Operator’s Certificate, in addition to the right to operate in civil aviation, determines that its holder complies with all ICAO International Aviation Safety Standards.
The requirements for obtaining the Operator Certificate are identical for both Low-cost carrier and other operators.
The main mandatory conditions for obtaining the User Certificate are:
In order to carry out commercial activities, it is necessary to have the status of a legal entity of the Republic of Uzbekistan. The Operator Certificate is issued to an individual only for personal needs (amateurs).
The air law of Ruz, when establishing a legal entity to obtain an operating certificate, does not establish mandatory requirements for the airline to have priority over a resident of the Republic of Uzbekistan.
However, it must be borne in mind that, if the foreign resident has priority possession, There is a risk that a foreign State will be denied access to the flights of such an airline to that State on the basis of the Air Services Agreement between States, which establishes that right among the contracting parties.
Presence of:
Aircraft under ownership or lease without crew (aircraft under art. 38 of the Air Code must have a type certificate issued by the Inter-State Aviation Committee (IAC) and be equipped, as appropriate, for the declared types and regions of flight).
Air Service Structures (the flight crew must have the necessary qualification and training, as well as the corresponding pilot certificate issued by the Civil Aviation Agency, in case of hiring foreign pilots, it is necessary to pass the process of recognition of certificates (licenses) of these pilots at the Civil Aviation Agency;
Technical services (the technical staff shall have the necessary qualifications and training for a specific type of Inland Navigation Service as well as an appropriate Inland Navigation Maintenance Certificate; issued by the Civil Aviation Agency. The Technical Service must have a certificate issued by the Agency for Maintenance of the Armed Forces, issued by the Civil Aviation Agency. If the maintenance on contractual terms is carried out by external organizations, then such organizations should be certified or recognized by the Civil Aviation Agency).
The main place of activity of the operator and the base of aircraft should be in the territory of the Republic of Uzbekistan (at one of the airports of the Republic of Uzbekistan).
In accordance with the Air Code of the Republic of Uzbekistan, all civil aircraft must undergo the compulsory registration procedure with the Civil Aviation Agency, at the end of which each aircraft receives the certificate of registration of the civil aircraft.
It is further necessary to receive in accordance with the established procedure for each aircraft:
- Airworthiness certificate
- radio equipment certificate
- noise certificate.
In the case of registration of the Armed Forces in a foreign State, all these documents are issued by the State of registration, with which the Civil Aviation Agency is required to conclude the Agreement on the Implementation of Article 83bis of the Chicago Convention of ICAO, The delegation of authority to Uzbekistan from the State of registration, as well as the functions and responsibilities, including oversight and control functions, deriving from Annexes 1, 2 and 6 of the Convention.
The applicant is obliged to develop and approve (approve) the following documents of the airline at the Civil Aviation Agency:
- The Flight Production Manual;
- Operation Manual of the Force Maintenance Regulator;
- Aviation Safety Management System Manual;
- Aircraft Operation Manual (for each type);
- Guidelines for regulating the mass and centring of aircraft;
- Manual on ground handling of aircraft;
- Aircraft Operations Manual (for each type);
- Maintenance programme (for each type);
- Ground and flight training programme for crew members;
- Minimum list of equipment (for each type);
- Operator’s Aviation Security Program.
- Upon receipt of the Operator Certificate in accordance with the requirements of the Convention on International Civil Aviation (ICAO), registration in the ICAO Registry is mandatory for all Inland Operators. The request for registration must be placed through the 3LD system on the site http://www.icao.int/3ld.
Upon registration, the Air Force operator will receive a 3-letter ICAO code and a telephone symbol for the Uzbek commercial operator.
As soon as the three-letter ICAO code is available, the airline can proceed with commercial flights.
